Please read these terms carefully before using the AlfaCare healthcare intelligence platform. By accessing or using our services, you agree to be bound by these terms.
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and AlfaCare Technologies Pvt. Ltd. ("AlfaCare," "we," "our," or "us"), governing your access to and use of the AlfaCare platform, website, mobile applications, and all associated services (collectively, the "Services").
By accessing or using AlfaCare's Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, please discontinue use of the Services immediately.
These Terms apply to all users of the AlfaCare platform, including registered medical practitioners, healthcare coordinators, patients, and authorized representatives of healthcare facilities. The Services include but are not limited to: advanced clinical decision support, patient health record management, clinic operations management, and all related digital tools.
Your use of AlfaCare constitutes your acceptance of these Terms. For institutional users, the individual creating an account on behalf of an organization represents that they have authority to bind the organization to these Terms. Acceptance occurs at the earliest of: (a) clicking "I Agree," (b) creating an account, or (c) accessing any part of the Services.
You must be at least 18 years of age and legally capable of entering into binding contracts to use AlfaCare. Medical professionals must hold valid, current licenses in their jurisdiction. Use by individuals who do not meet these requirements is expressly prohibited.
As a user of the AlfaCare platform, you bear significant responsibilities regarding account management, data accuracy, and compliance with applicable laws and regulations. Your adherence to these responsibilities is essential to the integrity and safety of our healthcare ecosystem.
You are solely responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify AlfaCare of any unauthorized use of your account. AlfaCare shall not be liable for losses arising from unauthorized use due to your failure to secure account credentials.
All users must comply with applicable healthcare regulations, data protection laws, and professional standards in their jurisdiction. Medical practitioners are responsible for ensuring their use of platform-generated insights complies with their professional licensing requirements and applicable medical regulations.
AlfaCare operates in compliance with HIPAA (Health Insurance Portability and Accountability Act) standards. Users processing health information must similarly adhere to all applicable data protection and healthcare privacy laws in their jurisdiction.
The quality of clinical insights is directly dependent on the accuracy of data entered into the platform. You are responsible for ensuring that all patient data, clinical records, and medical information entered into AlfaCare is accurate, complete, and up-to-date. AlfaCare disclaims all liability for clinical decisions based on inaccurate or incomplete data submitted by users.
Users must not engage in the following activities:
AlfaCare and its licensors own all intellectual property rights in the Services and all content, software, technology, algorithms, and materials made available through the platform.
The AlfaCare platform, including its models, algorithms, user interface designs, clinical decision support systems, and all related technology, is protected by copyright, patent, trademark, and other intellectual property laws. All rights, title, and interest in and to the Services remain exclusively with AlfaCare Technologies Pvt. Ltd.
Subject to your compliance with these Terms, AlfaCare grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for their intended healthcare purposes. This license does not include the right to:
You retain ownership of all patient data and medical records you upload to AlfaCare. By uploading data, you grant AlfaCare a limited, non-exclusive license to process this data solely for the purpose of providing the Services. AlfaCare will not sell, transfer, or use your clinical data for purposes other than service delivery and platform improvement in accordance with our Privacy Policy.
"AlfaCare," the AlfaCare logo, "Alfa Summary," "Alfa Reports," "Alfa Vitals," "Alfa Diagnosis," "Alfa Suggestions," and "Alfa Chat" are registered trademarks or trademarks of AlfaCare Technologies Pvt. Ltd. Unauthorized use of these marks is strictly prohibited and may result in legal action.
The following limitations of liability apply to the fullest extent permitted by applicable law. These provisions significantly affect your legal rights. Please read carefully.
THE ALFACARE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ALFACARE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AlfaCare does not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALFACARE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
AlfaCare's total aggregate liability to you for any and all claims arising out of or relating to these Terms or the Services shall not exceed the greater of: (a) the total fees paid by you to AlfaCare in the twelve (12) months preceding the claim, or (b) one hundred United States dollars (USD $100).
AlfaCare is a clinical decision support tool. All platform-generated insights, diagnoses, and suggestions are intended to assist — not replace — the professional judgment of licensed medical practitioners. Final clinical decisions must always be made by qualified healthcare professionals.
AlfaCare's systems are trained on large medical datasets and are designed to provide clinical decision support. However, models can produce errors, may not account for individual patient nuances, and cannot substitute for a physician's clinical examination, history-taking, and professional judgment. All clinical outputs must be independently verified by the treating clinician.
AlfaCare is NOT designed for emergency medical situations. In the event of a medical emergency, immediately call your local emergency services (112 or 108 in India). Do not rely on AlfaCare as a first response tool in life-threatening situations.
Licensed healthcare practitioners using AlfaCare remain solely responsible for all clinical decisions, diagnoses, treatment plans, and patient outcomes. The use of AlfaCare's tools does not transfer or diminish a clinician's professional or legal obligations to their patients. Practitioners must exercise independent professional judgment when reviewing and applying platform-generated clinical insights.
AlfaCare reserves the right to modify, update, or replace these Terms at any time at its sole discretion. Modifications may be made to reflect changes in: applicable laws or regulations, platform features and services, business practices, or security requirements.
For material changes to these Terms, AlfaCare will provide notice through one or more of the following methods:
Your continued use of the Services after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, you must discontinue use of the Services and may request account termination in accordance with Section 7.
You may terminate your AlfaCare account at any time by submitting a written termination request to [email protected] or through the account settings panel. Account termination requests will be processed within 30 business days. During this period, you retain access to export your data.
AlfaCare reserves the right to suspend or terminate your account immediately, with or without notice, if you:
Upon termination: (a) your license to use the Services immediately ceases; (b) AlfaCare may delete your account data after a 90-day retention period; (c) provisions that by their nature should survive termination — including intellectual property, liability limitations, and dispute resolution — shall continue in full force. You may request a data export prior to account deletion.
These Terms and your use of the AlfaCare Services shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
AlfaCare operates in compliance with applicable healthcare regulations including the Digital Personal Data Protection Act (DPDPA) of India, Information Technology Act 2000, and the National Medical Commission (NMC) guidelines.
Before initiating any formal dispute process, you agree to first attempt to resolve any dispute informally by contacting AlfaCare at [email protected]. AlfaCare will make good-faith efforts to address your concern within 30 calendar days. This informal process is a prerequisite to any formal dispute mechanism.
If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved by binding arbitration conducted in Patna, Bihar, India. The arbitration shall be conducted in the English language, and the arbitral award shall be final and binding.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You expressly waive your right to participate in any class action lawsuit or class-wide arbitration against AlfaCare.
Any claim or cause of action arising from these Terms or the Services must be filed within one (1) year after the cause of action accrues. Claims filed after this period shall be permanently barred.
